Apostille Explained

What Is a Florida Hague Apostille?

A Florida Hague apostille is an official certificate issued by the Florida Department of State that authenticates a public document for international use in countries that are members of the Hague Convention.

Apostille certification verifies the signature and authority of the issuing official so the document can be legally recognized abroad. Only the Florida Department of State may issue apostilles — private services like MK Notary assist with preparation and submission.

Our Tallahassee office is located near the Florida Department of State, allowing us to submit requests locally for efficient processing. "Because we submit in person at the Tallahassee office, we can often avoid the 21+ day mail-in queue".

EXAMPLE

Birth Certificate for a Portuguese Residency Visa

A Tallahassee client needed her Florida birth certificate apostilled for a Portuguese residency application. We confirmed the Florida document was a certified copy from the Bureau of Vital Statistics (a requirement many clients don't know about), verified the Portuguese destination requirements under the Hague Convention, assembled the submission packet, and delivered the authenticated document in time for her visa appointment. "Same-day and next-day processing available for eligible documents submitted locally. Standard turnaround: 48 hours or less for most Florida documents. Processing times are set by the FL DOS and subject to state volume — we provide realistic estimates upfront."

Power of attorney for an overseas property transaction

A Power of Attorney (POA) intended for use in an overseas property transaction must meet specific requirements before it can receive an apostille. First, the document must be properly prepared and signed. In most cases, the POA should be notarized by a Florida Notary Public, confirming the identity of the signer and the voluntary execution of the document. Once notarized, the document may be submitted to the Florida Department of State for apostille certification, which verifies the authenticity of the notary’s signature for use in countries that are members of the Hague Apostille Convention. However, it is strongly recommended that the Power of Attorney be drafted or reviewed by a qualified attorney in the destination country. Each country has specific legal requirements for property transactions, and using a locally compliant POA helps ensure the document will be accepted without delays or rejection. FAQ

Frequently Asked Questions

"Frequently Asked Questions Information last reviewed: March 2026. Processing times and procedures are subject to change — contact us to confirm current timelines before submission."
Processing timelines listed reflect typical FL DOS volume as of early 2026 and may vary. We provide realistic, up-to-date estimates during your initial consultation.

(850) 322-5127

Is MK Notary Services authorized to issue apostilles?

No. Under the Hague Convention, only designated Competent Authorities may issue apostilles. In Florida, that is the Florida Department of State (Office of the Secretary of State). MK Notary Services assists with preparation and submission of apostille requests but does not issue apostilles.

Which documents can obtain an apostille?

Many Florida-issued documents may qualify — birth, death, and marriage certificates, court documents, divorce decrees, school transcripts and diplomas, corporate records filed in Florida, and notarized documents. Requirements vary by document type and destination country. Contact us to confirm eligibility before submission.

Do vital records need additional documentation?

Yes. Florida vital records must be certified copies issued by the Florida Bureau of Vital Statistics and signed by the current State Registrar. Only properly issued certified copies can be submitted for apostille authentication. We review documents before submission to help reduce delays.

How long does the Florida apostille process take?

Process information last reviewed: March 2026. For the most current Florida Department of State processing estimates, please contact us directly or refer to the official website. Processing times are determined by the Florida Department of State and vary based on workload and submission method. Mail-in requests may exceed 21 days. Documents submitted locally in Tallahassee may be processed more quickly depending on State volume and document type. We assist in preparing documents accurately to help reduce delays and avoid unnecessary rejections.

What happens if FL DOS rejects my document?

If the Florida Department of State returns a document for correction, we review the rejection reason, advise on next steps, and assist with resubmission where possible. Common rejection causes are missing notarization or uncertified vital record copies — we check for these before submission.

Can you help with documents from other states?

We specialize in Florida-issued documents. Documents issued in other states must be authenticated through that state's designated authority. We do process most of the US States.

Do you handle federal document apostilles?

Federal documents (e.g., FBI background checks, federal court records) require authentication through the U.S. Department of State in Washington, D.C. We do handle the federal process and can advise on document preparation.

What if my destination country is not a Hague Convention member?

Countries not party to the Hague Convention require a different authentication process called legalization (or consular authentication). We can advise on whether your destination country requires this and what the process involves.

Can I use a scanned or digital copy of my document?

No. The Florida Department of State requires original documents or certified copies — photocopies and digital files are not accepted for apostille.

Do you offer mobile or in-person pickup services?

Yes. We offer same-day mobile service within Leon County. Contact us to confirm availability.

Can you help with translations along with apostilles?

Yes. Some destination countries require certified translations of documents before or after apostille authentication. We provide translation assistance when needed to support international document compliance.
